慈善信(xin)(xin)(xin)(xin)(xin)托(tuo)(tuo)(tuo)(tuo)(tuo)是指依據(ju)信(xin)(xin)(xin)(xin)(xin)托(tuo)(tuo)(tuo)(tuo)(tuo)制度，慈善捐贈者(zhe)以委(wei)托(tuo)(tuo)(tuo)(tuo)(tuo)人(ren)(ren)(ren)身份，基于對受托(tuo)(tuo)(tuo)(tuo)(tuo)人(ren)(ren)(ren)（信(xin)(xin)(xin)(xin)(xin)托(tuo)(tuo)(tuo)(tuo)(tuo)公(gong)司或慈善組織(zhi)）的(de)(de)信(xin)(xin)(xin)(xin)(xin)任，將財產(chan)(chan)委(wei)托(tuo)(tuo)(tuo)(tuo)(tuo)給(gei)受托(tuo)(tuo)(tuo)(tuo)(tuo)人(ren)(ren)(ren)，由受托(tuo)(tuo)(tuo)(tuo)(tuo)人(ren)(ren)(ren)按照委(wei)托(tuo)(tuo)(tuo)(tuo)(tuo)人(ren)(ren)(ren)的(de)(de)意愿管理(li)和處分(fen)信(xin)(xin)(xin)(xin)(xin)托(tuo)(tuo)(tuo)(tuo)(tuo)財產(chan)(chan)，從而實(shi)現(xian)慈善目(mu)的(de)(de)。相比營業信(xin)(xin)(xin)(xin)(xin)托(tuo)(tuo)(tuo)(tuo)(tuo)，慈善信(xin)(xin)(xin)(xin)(xin)托(tuo)(tuo)(tuo)(tuo)(tuo)作(zuo)為一種特殊信(xin)(xin)(xin)(xin)(xin)托(tuo)(tuo)(tuo)(tuo)(tuo)，需(xu)滿(man)足三個條件(jian)，即信(xin)(xin)(xin)(xin)(xin)托(tuo)(tuo)(tuo)(tuo)(tuo)目(mu)的(de)(de)的(de)(de)慈善性、信(xin)(xin)(xin)(xin)(xin)托(tuo)(tuo)(tuo)(tuo)(tuo)效果的(de)(de)公(gong)益性、信(xin)(xin)(xin)(xin)(xin)托(tuo)(tuo)(tuo)(tuo)(tuo)的(de)(de)完全慈善性。
